Law is a tool for realizing the society humans aspire to. Alongside growing environmental awareness, rules concerning the environment have increased to meet the demands of the times. This course provides an overview of how law functions in addressing environmental issues for students encountering "environmental related law" for the first time. Next, through specific environmental court precedents and case studies, students will learn what rules have been established domestically and internationally to resolve various environmental issues. Additionally, through considering the interconnectedness of environmental laws covered in each session, we will address what must be protected and what responses are necessary to achieve environmental justice.
By the end of the course,students should be able to understand following three points:
・Understand the overall picture of environmental issues, including their background, characteristics, key problems to be solved, and remaining legal challenges.
・Gain a basic understanding of the relationship between environmental issues and law.
・Be able to present own views on solving environmental issues based on legal basis.
Learn the fundamentals of legal systems that play a crucial role in addressing environmental issues. This course introduces the framework of environmental law relevant to various fields as students deepen their specialization in subsequent years. Specifically, it clarifies the characteristics and challenges of environmental law through studying the historical development of systems and theories in both domestic and international law, fundamental principles and ideals, current major legal systems, and specific related cases. For students wishing to deepen their understanding of the environment from a legal perspective, it serves as an introductory course to the advanced subjects “International Environmental Law" and “Environmental Administrative Law".

受講生の興味関心に応じて、取り上げる環境問題を若干変更する場合があります。
本講義は、単に環境に関わる問題を考えるのではなく、その背景や解決方法に至るまで考え抜くことを大切にします。履修にあたっては、日頃から報道や新聞、インターネットなどから様々に情報を集めておくことで理解が深まります。
法は、人間が理想とする社会を実現するためのツールです。環境への関心の高まりとともに、時代に応じた環境に関わるルールが増えてきました。本授業では、「環境に関わる法」を初めて学ぶ学生のために、まず環境問題に対して、法がどのような機能を果たしているのかを概観します。次に、具体的な環境に関わる判例や事例を通じて、さまざまな環境問題を解決するために、どのようなルールが国内外で整備されているかを学びます。併せて、各回で取り上げる環境に関わる法の繋がりを通じて、環境正義を実現するために何が守られるべきか、必要とされる対応はなにかを扱います。
本授業の到達目標は下記の３点です。
・環境問題が生じた背景、特徴、解決すべき問題点、残されている法的課題などの全体像を理解することができる
・環境問題と法の関係について、初歩的な理解ができる
・環境問題の解決について、法的根拠を示しながら、自分の見解を示すことができる

環境問題の解決に重要な役割を果たす法制度の基礎を学びます。２年次以降の専門性を深めていくうえで、さまざま領域に関わる環境法の基本的な枠組みを紹介します。具体的には、国内法・国際法それぞれにおける制度や理論の歴史的発展、基本原則や理念、主要な現行法制度、それらにかかわる具体的な事例などの学びを通じて、環境法の特色や課題を明らかにしていきます。法的観点から環境への理解を深めたい学生にとっては、特に発展科目「国際環境法」「環境行政法」の導入的な役割を果たします。
