【Course Objectives】

The objective of this course is to present Japanese criminal procedure as seen by Japanese and international scholars.

【Course Contents】

This course will present Japanese criminal procedure from a historical and comparative perspective.
The lessons will cover many aspects of Japanese criminal procedure, including its history, constitutional dimension and current form, with a particular focus on current practice.

【授業計画 / Course Schedule】

1 History of criminal law and procedure before the Meiji period.
2 The reception of Western criminal law in the Meiji period.
3 Criminal law 1900-1945. The first jury.
4 Criminal law reforms after WWII: Constitution and laws.
5 Overview of the criminal procedure: Basic structure, participants in criminal proceedings.
6 Investigation: Beginning of investigation, compulsory and voluntary investigations.
7 Investigation: Arrest and detention, search and seizure, interrogation.
8 Trial: Overview, lay judge system.
9 Evidence: Relevancy, confession, hearsay.
10 Death Penalty: Nagayama Criteria

Lessons require active participation by the students. Short in-class tests will be held at regular intervals. Participants will be required to give an individual or group presentation on selected topics.

Participants will be required to read regularly the assigned materials in English in preparation for the lessons.
Participants will have to prepare a final individual or group presentation.

Ability to listen to a class in English and engage in simple conversations in English about the topics presented.
Basic knowledge of Japanese history since 1868.
A suitable English language proficiency level is a minimum of IELTS 6.0 or equivalent.
