The objective of this course is to achieve an accurate understanding of the area concerning rights guaranteed by various provisions in Chapter 3 of the Constitution. Students are expected to understand problems on their own and cultivate the ability to develop persuasive arguments using the accumulated judicial precedents and theories as resources.
The classes will lecture about the development of judicial precedents and theories so that students may accurately understand the way in which the rights established under Japanese Constitutional Law are guaranteed. While the limits of judicial guarantees will also be considered, the main focus will nevertheless be on a critical evaluation of judicial precedents.

憲法学の体系のうち、憲法第3章の諸規定により保障される権利に関わる領域について、正確な理解を得る。判例・学説の蓄積を資源として、自ら問題を把握し、説得力ある議論を展開する能力を涵養することが、期待される。

日本国憲法下で、その定める権利がどのように保障されているかを的確に把握できるよう、判例・学説の展開を丁寧に講述する。裁判的保障の限界にも留意するが、やはり判例法理の批判的検討が中心になる。
