This course addresses the main issues concerning institutional design of government under the Japanese Constitution.
This course is designed to provide essential knowledge of the key principles and practices of governmental structure, including the separation of powers, pacifism, parliamentary system, judicial review, and local self-government. Each topic will be explored with close attention to how it relates to and functions within the overall framework of the Japanese Constitution. Compared with other black-letter law courses, court precedents make up a relatively smaller portion of the materials, but they remain the most important component.

憲法学の体系のうち、講学上の「統治機構論」に該当する領域について、正確な理解を得る。判例・学説の蓄積を資源として、自ら問題を把握し、説得力ある議論を展開する能力を涵養することが、期待される。
This course addresses the main issues concerning institutional design of government under the Japanese Constitution.
日本国憲法が定める統治機構の全体設計への視点が疎かにならないよう意を用いつつ、個々の裁判例、学説間の対立が、いかなる具体的な問題について議論を重ねてきたか、丁寧に講述する。具体的な解釈論と関連性を有する範囲で、権力分立など抽象度の高い理論的な問題にも立ち入るが、両者の間の連関は常に意識して講義を進める。統治機構分野では司法過程に現れない議論も少なくないため、判例の解説が占める割合は相対的に低くなるが、それでも判例が最も重要な検討素材を提供するだろう。
