To establish basic understanding of the following topics of civil procedure: complex litigations, appellate procedure, and action for retrials.
This course, based on the knowledge acquired through Civil Procedure(1), introduces, firstly, complex litigations, which includes actions with multiple claims and/or actions in which third parties―other than one plaintiff and one defendant―involved. Then, we move on to processes of appeals against judgement of lower courts and action for retrials of concluded cases. Additionally, review of last year’s Civil Procedure (1) will also be conducted.

民事訴訟の複雑訴訟及び上訴・再審についての基本的な事項を理解すること。
To establish basic understanding of the following topics of civil procedure: complex litigations, appellate procedure, and action for retrials.
民事訴訟法(1)で得られた知見を前提として、本講義の前半（複雑訴訟）では、判決手続が、複数の請求を併せて審理判断することになるため、あるいは、一人の原告と一人の被告以外の者が関与することになるために複雑化する現象、及びその複雑化した判決手続がどのように規律されるかについて解説する。後半（上訴・再審）では、第一審における敗訴当事者が上級裁判所によるその見直しを求める場合に行われる上訴手続、また、確定した判決の取消しを求めてする再審の訴えに関する手続について解説する。なお、講義の前半では、昨年度の民事訴訟法(1)における学習範囲の復習も実施する。
