Our main objectives are (i) to become familiar with basic civil litigation and civil procedure topics across multiple countries (e.g., Japan, the US, India, Germany) and (ii) to obtain valuable procedural lessons from assessments of historic/influential civil lawsuits.
A supplementary objective is to raise our awareness of modern/ongoing civil litigation trends - namely, the types of claims being filed in today's world (e.g., climate litigation and breach of privacy claims) and plaintiffs' procedural strategies.
Throughout this course, we will explore the process of civil litigation, from the initiation of a lawsuit to its resolution through dismissal, judgment, or appeal. Civil litigation involves resolving disputes in court through a series of structured phases, including pretrial, trial, and post-trial activities, all governed by procedural rules and evidence standards. Via explorations of the legal frameworks of jurisdictions such as Japan, the United States, India, and Germany, this class will introduce foundational concepts of civil procedure, emphasizing their practical application and comparative aspects. Students will gain insights into the mechanisms that (hopefully) ensure fairness, efficiency, and justice in civil disputes.

Rather, a willingness to learn and engage in activities to the best of one’s abilities – in class-wide settings, in small groups, and/or even via interactions with the lecturer himself (in person or by email) - along with improvement over the entire course will be highly regarded.]
