The objective of this course is to understand the structure of the Antimonopoly Act and the Act Against Unjustifiable Premiums and Misleading Representations while cultivating the legal ability to think critically and an understanding of economics through studying these two acts.
This course will explain the Antimonopoly Act regulations with a focus on unfair trade practices.
As a general introduction to unfair trade practices, the classes will explain the concept of "inhibition of fair competition" before covering various theoretical behavior patterns such as resale price restrictions, dumping, and the abuse of a dominant bargaining position. The course is also scheduled to cover regulations in the Act Against Unjustifiable Premiums and Misleading Representations as a related set of regulations.

独占禁止法や景品表示法を学習する際には、憲法や民法や刑法など基本的な実定法科目の学修を通じて獲得される法的思考力を有することが有益である。したがって、1 年次配当の実定法科目のいくつかを履修済みであるか、又は並行して学習することが望ましい。

独占禁止法と景品表示法の仕組みを理解するとともに、独占禁止法と景品表示法の学習を通じて、法的思考力と経済に関する理解を涵養することを目標とする。

独占禁止法の規制のうち、不公正な取引方法の規制を中心に解説する。
不公正な取引方法の総論として「公正競争阻害性」概念について解説したのち、各論的な行為類型である再販売価格の拘束、不当廉売、優越的地位の濫用といった様々な行為類型を取り上げる。関連する規制として景品表示法の規制も取り上げる予定である。
