This course is designed to prepare students who will practice intellectual property (IP) law in the global marketplace by learning about the subject matter of various IP laws, including patent law, industrial design law, copyright law, trademark law, unfair competition law, and geographical indication law, and understanding the differences between Japan, the U.S., and Europe in the protection of these subject matters.
First, students will study the main intellectual property treaties and how the obligations under these treaties are implemented in the national laws of the European Union and the United States (US). Second, students will study and compare the legal systems of the EU and US IP systems to understand the basic concepts of the scope of protection and rights covered by patent law, plant variety and seed protection law, trademark law, design patent law, unfair competition law, copyright law and geographical indication law in Japan, the US and Europe, and to consider how these rights can be combined to protect products and services in the global marketplace. In each lecture, students are divided into small groups and discuss strategies and policies for protecting intellectual property, thereby developing their creativity and English communication skills.

この講義では、特許法、意匠法、著作権法、商標法、不正競争防止法、地理的表示法等の知的財産法の保護対象を学び、これらの保護対象の保護の日米欧の違いを理解することで、学生がグローバル市場における知的財産法法曹実務家となる基礎知識を養う。各知的財産権の対象に保護を与える理由と政策目的を理解し、議論することで論理的思考を育てる。

最初に、学生は主な知的財産権に関する条約と、これらの条約に基づく義務が、欧州連合(EU)および米国(US)の国内法でどのように履行されているかを学ぶ。次に、EUと米国の知的財産制度の法体系を比較検討し、日本、米国、欧州における特許法、植物品種および種子保護法、商標法、意匠特許法、不正競争防止法、著作権法、地理的表示保護法による保護の範囲と権利の基本的な概念を理解し、これらの権利をどのように組み合わせればグローバルな市場で製品やサービスを保護できるかを検討する。各講義では、学生は少人数のグループに分かれ、知的財産を保護するための戦略や政策について議論し、創造性と英語でのコミュニケーション能力を養う。
