In this course, you will learn about the basic structure and content of Japanese laws and regulations related to antimonopoly, protection of personal information, and security of economic transactions. We will also explain these laws in light of their practical applications in business, including the points to consider when reviewing contracts, and have you develop a practical perspective. The Antimonopoly Act-related laws and regulations covered in this course will help to explain what “competition” is, and we will also take up topics regarding smartphones and platformers like GAFAM that are indispensable in our daily lives. In addition, understanding the laws and regulations related to the protection of personal information is becoming increasingly important especially in B to C businesses, because data including personal information is widely used. Furthermore, under the current tense international situation, risk management for companies is becoming more important and difficult, and it is essential to understand economic security-related laws and regulations.
We will be lecturing on the basic concepts and important issues of the Antimonopoly Act by using examples to make it easy to understand.
We will also cover other Antimonopoly Act-related laws, such as the Act against Unjustifiable Premiums and Misleading Representations.
We also plan to hold a joint lecture with Professor Toshiko Takenaka, who has been teaching patent law at the University of Washington in the US for many years. We will give a lecture on the relationship between patent law and the Antimonopoly Act, which may seem unrelated at first glance.
We will also give lectures that will make it easy to understand the basic concepts and important issues of the Act on the Protection of Personal Information and the economic security-related laws and regulations by using examples.
In each class, we will introduce issues and examples that often arise in actual legal practice.
In this course, you will learn about the above laws and regulations from a broad perspective, as well as acquire basic skills and develop a practical sense in such regard.

主に日本の独占禁止法関係法令、個人情報保護法関係法令、経済安全保障関係法令等の基本的な構造・内容を学んでいただきます。また、契約検討にあたっての留意点など、ビジネスでの上記法令の適用場面などを踏まえた解説も行う予定であり、実務的な視点も養っていただきます。この講義で取り上げる独占禁止法関係法令については、「競争」について分かりやすく説明するとともに、日常生活と切り離せないスマートフォンやGAFAMなどのプラットフォーマーも素材として取り上げます。また、個人情報保護法関係法令は、特にB to Cビジネスにおいては、個人情報を含むデータの利活用が広く行われており、これらの法令の理解は必須のものとなっています。さらに、経済安全保障関係法令は、昨今の緊迫した国際情勢の下では、企業のリスクマネジメントが一層重要かつ難しいものとなっており、これらの法令の理解は必須のものとなっています。

独占禁止法については、その基本的な概念や重要な論点について、事例も用いて分かりやすく講義をします。
独占禁止法以外の独占禁止法関連法令としては、不当景品類及び不当表示防止法等を取り上げて解説します。
また、長年米国ワシントン大学において特許法を教えてきた竹中俊子先生とのジョイント講義を行う予定であり、一見関係ないとも思える、特許法と独占禁止法との関係について講義します。
個人情報保護法関係法令、経済安全保障関係法令についても、その基本的な概念や重要な論点について、事例も用いて分かりやすく講義をします。
いずれの講義回においても、折に触れ、実際の弁護士業務においてよく問題となる論点や事例をご紹介します。
本講義においては、上記の法令について広い視点で学びながら、その基礎を身に着け、実務的な感覚も養うことができます。
