This course aims at acquiring a basic understanding of the American legal system and its societal and cultural background.
This course will begin by learning about the American governing system, including the legislative branch, the President, and the judicial branch. Students will gain an understanding of Federalism, where both the federal government and state governments share sovereignty. It will then discuss the process of realizing the law. Specifically, students will learn the common law system through the analysis of the development of products liability law, and also learn the unique features of American civil and criminal procedure. In the last part, the classes will focus on two kinds of human rights protection, equal protection and substantive due process under the Bill of Rights.
In each class, the lecturer will pick up representative judgments and aim at delivering vivid image and of the features and dynamism of American law. Thus, students are expected to read assigned cases in advance and to participate in classes actively.
Lastly, America is a treasure house of good legal movies. The lecturer plans to give a brief introduction to movies related to the issues of the class.

アメリカの法制度とその背景にある社会・文化についての基礎的な理解を身につける。
This course aims at acquiring a basic understanding of the American legal system and its societal and cultural background.
冒頭では、アメリカの統治機構－連邦議会、執行府/大統領制及び司法制度について学び、連邦政府と州との双方が主権を有する連邦制度（Federalism）の特性を理解する。その後、具体的な法の実現過程につき学ぶ。製造物責任法の発展を素材に判例法主義とは何かを理解したのち、民・刑事の訴訟手続の特徴を理解する。最後に、権利章典（Bill of Rights）による人権保障のうち、平等保護条項及び実体的デュープロセスを取り上げる。各回では歴史的及び現代アメリカにおける代表的な判例・事例を取り上げ、そこにあらわれているアメリカ法の特徴及び法的・社会的背景を具体的に理解することを目指す。学生には事前に判例・事例に目を通し、授業に積極的に参加することを期待する。なお、アメリカは所謂「法廷もの」「法律もの」映画の宝庫である。授業で扱う各トピックをテーマとした映画を適宜紹介していきたい。
