The objective of this course is to think about the role of law in solving unknown problems in the real world through the process of using law to understand how French society differs.
At first glance, the following two cases seem to be unrelated, but they are both tied together by their deep impact on the French legal system.
(1) A Canadian woman is searching for her father in the Middle East, but what led her to this search?
(2) The world's leading multinational water utility company is focused on earnings stability and is planning on entering the water utility business in a certain Japanese municipality. How did this company construct their business model? Moreover, what is the estimate of their success in Japan where public water utilities are common?
Just as the world is getting smaller due to technological progress, trivial social relationships in our daily lives are getting more complicated and multilayered. When coming into contact and trying to understand people who live a different existence than us, what points should we pay attention to and with what attitude should we approach the situation? What kind of role can law play in that case?
The lectures will use France as source material to address these types of problems.
The classes will be largely divided into three areas and rely on a pluralistic approach to explore French society and its relationship with the supporting legal system while mobilizing the students’ knowledge of Positive Law, Basic Law, And Political Science.
First, the knowledge of Japanese law which students have already studied will be used as a starting point to compare and understand the characteristics of French law.
Next, we will examine the unique characteristics of French law while comparing it with multiple nations.
Finally, after proceeding through the previous steps, we will deeply analyze the relationship between society and the law in France and consider the cases mentioned at the beginning through the response to various issues commonly faced by international society and European society.
What kind of comprehensive perspective can be developed after persistently studying the carefully constructed Rikkyo University College of Law and Politics curriculum? It is hoped that the students who enroll in this class will be able to experience the view from such a perspective before concluding their baccalaureate undergraduate degree.

法学を用いてフランスという異社会を理解する過程を通じて，実社会での未知なる課題解決のための法学の役割について考えます。

一見何の関連もない次の2つの事例に共通するのは，いずれもフランス系の法制度が深く関わっている，という点です。
①中東で父親を捜すカナダ人女性は，何がきっかけでそのようにしているのだろうか。
②世界一の多国籍水道事業会社は，収益の安定性に目をつけ，日本のある自治体での水道事業に参入しようと計画している。この企業はどのようにしてビジネスモデルを構築してきたのか。また，公営水道が主流の日本において，成功の目算があるのだろうか。
技術の発展により地球が狭くなった分だけ，日常の些細な社会関係ですらもますます複雑化し，なおかつ，重層化しています。自分たちとは異なる存在に触れ，これを理解しようとする場合に，どのような点に注意し，どのような姿勢で臨めばよいのでしょうか。その際，法学はどのような役割を担えるのでしょうか。
本講義は，フランスを素材として，これらの問題に取り組みます。
授業では，実定法学，基礎法学，政治学の知見を総動員しながら，多元的な接近法によりつつ，大きく3つに分けて，フランス社会とそれを支えている法制度の関係について探究していきます。
まず，既に学んだ日本法の知識を起点に，これらと対照することでフランス法の特徴を把握します。
次いで，多国間のなかで比較しながら，フランス法の個性についてさらに検討を加えます。
最後に，これまでの段階を踏まえたうえで，国際社会や欧州社会が抱える各国共通の諸課題への対応を通して，フランスにおける社会と法の関係を深く分析し，また，冒頭の事例に対する考察を行います。
入念に組み上げられた立教大学法学部のカリキュラムを着実に学修した先には，どのような総合的視野がひらけているのでしょうか。学士課程のまとめを兼ねて，受講者諸君にその眺望を体感して頂ければ，と考えています。
