Focusing on the core subject of the Common law (Property), whose substantive law cannot be separated from its history, the aim is to understand the core concepts without going through Japanese, that is, without using the concepts of Japanese law. Learn both the substantive law and history of the Common law simultaneously through the latest textbooks by top British scholars.
Focusing on Property, Equity, and Trusts, this lecture examines the formation of the Common law, particularly through issues related to land. It aims to understand how the trusts, often referred to as the jewel of the Common law, were devised and developed. The goal is to comprehend the various concepts of Common law, such as tenure, estate, holdings, lease, etc., without translation, without going through Japanese legal terminology, which is civilian. The course textbook, all the chapters of which were written by the top English scholars of each area of law and then put into Japanese, is totally new in its style of translation, leaving all the important legal terms in English.

街を歩いていると○○エステートという会社名を目にする。ｘｘホールディングスもおなじみのもの。大学教授の職はテニュアと言われたりする。ビルのテナント、コピー機のリース・・・これらのカタカナ言葉はすべてコモン・ローの法概念である。なぜカタカナなのか？なぜ日本語に訳さないのか？ではPropertyは何と訳すか？財産？所有（権）？これらのコモン・ローの法概念は訳せない、訳せば色々な無理が出てくる。
本授業では、コモン・ローの法概念を日本語を経由することなく、つまり日本法の概念を経ずに理解することを目標とする、全く新しいコンセプトに基づく教科書（日本語）を用いる。考察対象とするのは、コモン・ローのセンターにあるLaw of Property。コモン・ローの法形成を、Property, Equity, Trustsを中心として、特に土地をめぐる問題を通して考察する。tenure, estate, holding, lease, equityといった概念が、なぜカタカナのまま日本社会に入ってきているのか、コモン・ローの華と言われるTrustがどのように誕生したかを、その根幹から理解する。
