This lecture is designed to enable students to present a legal system for solving environmental problems, using the legal system, theories and case law as a starting point. The specific objectives of the course are as follows
1. to understand the basic principles of environmental law
2. to understand the laws that make up environmental law
3. to understand the development of case law on environmental issues
This lecture will cover the legal system and case law relating to environmental issues. Specifically, the background and basic principles behind the emergence of the system in the area of environmental law (1st - 3rd), the laws that constitute the area of environmental law (4th - 13th) and environmental administrative litigation (14th) will be covered. By analysing the various laws and judicial precedents, I hope to bridge this with an understanding of administrative law.

事前に配布されることになる参考資料に目を通すようにし、授業後も簡単で良いので確認するようにしてください（14回×1時間程度）。また、知識を問う設問だけではなく、論述形式の試験も行う予定であるため、教科書も確認するようにしてください（30時間程度）。

公法学の視点から、環境法1の授業を行っていくことになるため、行政法1の履修済が望ましい。また、行政法2についても、履修中・履修済であることが望ましい（但し、行政法1・2の知識については、必要に応じて解説をするようにいたします）。その他、環境問題をより深く理解するために、環境法2も履修することを推奨いたします。
本科目につきましては、2025年度から担当となります。また、上記、授業計画につきましては、司法試験の環境法の試験範囲を念頭に置いたものとなりますが、少しでもご関心を持っていただけたら、担当者としては嬉しい限りです。
本講義は、環境問題に関して、法制度、学説、そして判例などを手掛かりにしつつ、その解決のための法制度を示すことができるようになることを最終的な目標とししています。その上で、具体的な到達目標は次の通りとなります。
1．環境法における基本原則を理解する。
2．環境法を構成する諸法律を理解する。
3．環境問題に関する判例の展開を理解する。

本授業は、環境問題に関する法制度及び判例について取り上げていくことになります。具体的には、環境法という領域における制度が登場した背景や基本原則（第1回目～第3回目）、環境法という領域を構成する諸法律（第4回目～第13回目）、そして環境行政訴訟（第14回目）となります。これらのうち、諸法律や判例を分析していくことで、行政法の理解とも架橋していければと思っております。
