The objectives of this course are to specifically understand the fundamentals of the field of private law (civil law) within the legal area called Environmental Law and to acquire the knowledge to handle various specific problems.
This class will fully cover the primary topics concerning Environmental Law in Japan, but the main subjects at that time will be private law disputes about the environment and their resolutions. For example, the study materials will primarily consist of damage claims, injunctions, and other civil litigation raised in cases where smoke and wastewater is emitted from a factory, pollutes the surrounding region, and damages the health of nearby residents. Students will need to prepare in advance by reading the textbook, and classes will be conducted according to the lecture summary provided ahead of time.
The field of public law (administrative law) is becoming extremely important within contemporary environmental law, so an explanation of legal systems and policies within the field of public law will be provided depending on the topic. However, such explanations will be limited to an overview due to time restrictions, so please use the textbook and reference literature to supplement your studies on your own.
Furthermore, this course is deeply interconnected with the separate discipline of "Environmental Law 1", so the content may overlap at times, but they are independent courses that can be taken separately.

| 授業では環境私法分野の主要な判決に言及しますが、それらを概観するには上記1のような判例集が便利です。また、本科目は民法（特に不法行為法）に基づく紛争解決を主要なテーマとしていることから、上記2のような不法行為法に関する参考書が授業内容の理解に役立ちます。 参考文献の購入は必須ではありませんが、不法行為法に関する標準レベルの参考書を用意して適宜参照するように心掛けてください。 | |||||
履修にあたって民法（特に不法行為法）に関する基礎知識が求められます。民法の学修経験が乏しい場合、不法行為法に関する参考書を用いた事前学修や不法行為法を扱う科目の事前履修を強く推奨します。
Web上の各種システムや、文書作成やPDF閲覧等のための一般的なアプリケーションを利用できる機器環境を用意してください。
授業運営にCanvas LMSやSpirit Mail（Gmail）などの各種システムを利用します。また、資料等は原則としてデジタルデータとしてCanvas LMSを通じて配布します。紙媒体が必要な場合には履修者自身がダウンロードして印刷し活用してください。
環境法と呼ばれる法領域のうち、特に私法（民事法）分野について、その基礎を理解し、 具体的な諸問題に対応するための知識を修得することが、この講義の到達目標です。
The objectives of this course are to specifically understand the fundamentals of the field of private law (civil law) within the legal area called Environmental Law and to acquire the knowledge to handle various specific problems.
この授業では国内環境法に関する主要トピックをもれなく取り上げますが、その際に環境に関する私法上の紛争とその解決を主題とします。例えば、工場から排出された煤煙や廃水が周辺地域を汚染し、近隣住民に健康被害が生じた場合に提起される損害賠償請求や差止請求といった民事訴訟が主な検討素材となります。授業はテキストによる予習を前提として、事前に提示する資料に沿って行われます。
現代の環境法においては公法（行政法）分野の重要性が非常に高くなっていますので、トピックによっては公法分野の法制度・政策についても解説しますが、時間の制約から概要にとどまりますので、テキストや参考文献を活用しつつ自習によって補ってください。
なお、別科目である「環境法１」の内容と深く関連し、内容が重複する場合もありますが、相互に独立した科目であり、単独での履修が可能です。
