The objective of this course is to provide students with an understanding of the fundamentals of environmental law, with a particular focus on private (civil) law, and to equip them with the knowledge needed to address specific issues.
This course provides a comprehensive overview of key topics in domestic environmental law, with a particular focus on environmental disputes under private (civil) law and their resolution.
The primary subject matter includes civil lawsuits—such as claims for damages or injunctions—that arise when environmental pollution, including smoke or wastewater discharged from factories, affects surrounding areas and poses health risks to nearby residents.
Students are expected to complete advance preparation using the designated textbook, and classes will be conducted based on materials distributed in advance.
While public law (administrative law) plays a significant role in contemporary environmental law, coverage of public law systems and policies in this course will be limited to an overview due to time constraints. Students are therefore encouraged to supplement their learning through self-study using the textbook and recommended references.
This course is closely related to the separate course “Environmental Law I,” and some overlap in content may occur. However, the two courses are independent and may be taken separately.
The field of public law (administrative law) is becoming extremely important within contemporary environmental law, so an explanation of legal systems and policies within the field of public law will be provided depending on the topic. However, such explanations will be limited to an overview due to time restrictions, so please use the textbook and reference literature to supplement your studies on your own.
Furthermore, this course is deeply interconnected with the separate discipline of "Environmental Law 1", so the content may overlap at times, but they are independent courses that can be taken separately.

| 授業では環境私法分野の主要な判決に言及しますが、それらを概観するには上記1のような判例集が便利です。また、本科目は民法（特に不法行為法）に基づく紛争解決を主要なテーマとしていることから、上記2のような不法行為法に関する参考書が授業内容の理解に役立ちます。 参考文献の購入は必須ではありませんが、不法行為法に関する標準レベルの参考書を用意して適宜参照するように心掛けてください。 | |||||
履修にあたって民法（特に不法行為法）に関する基礎知識が求められます。民法の学修経験が乏しい場合、不法行為法に関する参考書を用いた事前学修や不法行為法を扱う科目の事前履修を強く推奨します。
Web上の各種システムや、文書作成やPDF閲覧等のための一般的なアプリケーションを利用できる機器環境を用意してください。
授業運営にCanvas LMSやSpirit Mail（Gmail）などの各種システムを利用します。また、資料等は原則としてデジタルデータとしてCanvas LMSを通じて配布します。紙媒体が必要な場合には履修者自身がダウンロードして印刷し活用してください。
環境法と呼ばれる法領域のうち、特に私法（民事法）分野について、その基礎を理解し、 具体的な諸問題に対応するための知識を修得することが、この講義の到達目標です。

この授業では国内環境法に関する主要トピックをもれなく取り上げますが、その際に環境に関する私法上の紛争とその解決を主題とします。例えば、工場から排出された煤煙や廃水が周辺地域を汚染し、近隣住民に健康被害が生じた場合に提起される損害賠償請求や差止請求といった民事訴訟が主な検討素材となります。授業はテキストによる予習を前提として、事前に提示する資料に沿って行われます。
現代の環境法においては公法（行政法）分野の重要性が非常に高くなっていますので、トピックによっては公法分野の法制度・政策についても解説しますが、時間の制約から概要にとどまりますので、テキストや参考文献を活用しつつ自習によって補ってください。
なお、別科目である「環境法１」の内容と深く関連し、内容が重複する場合もありますが、相互に独立した科目であり、単独での履修が可能です。
