【授業の目標 / Course Objectives】

この授業では、例えば次のような問いに取り組む。現行の日本国憲法下で採られている議院内閣制は、諸国の統治システムのデザインと比較して、どのような特色をもつのであろうか？デモクラシーが世界大で直面している課題に向き合うために、日本国憲法下の経験からは、どのような教訓が引き出せるであろうか？比較憲法は、第一に憲法学の理解を比較の観点から深めることで、第二に比較という手法に憲法を素材として馴染むことで、上記のような問題群にアプローチする助けになるだろう。

Questions this course will pursue include the following: What are the distinctive features of the design of government structure established under the current Japanese Constitution, which is commonly characterized as parliamentary system? As democracies around the world face serious challenges, what lessons can be drawn from the experience of constitutional politics under the Japanese Constitution?
The study of comparative constitutional law can help address such questions in two ways: first, by deepening understanding of constitutional law through comparative perspectives, and second, by developing familiarity with the comparative methodology thorough the exploration of constitutions as materials.

【授業の内容 / Course Contents】

（1）比較憲法学のヴァリエーションと方法論、歴史を扱う総論を簡潔に説明した後、（2）政治部門、（3）司法・裁判所、（4）人権保障の順に、比較憲法分野の主要問題を検討する。議論の焦点は、基本的に日本国憲法とその下で展開した実践、理論に置かれ、その特徴を比較の観点から明らかにすることが、まずは目指される。そのような限定を越え出る比較憲法の蓄積（当然ながら、日本を検討対象に含まない比較憲法の業績は膨大にある）も、補充的に活用することがあり得る。

After a brief overview of the variations, methodologies, and historical development of comparative constitutional law, this course will examine the major issues in the field in the following order: (1) the institutional design of the political branches, (2) the judiciary and courts, and (3) the protection of fundamental human rights. The course will focus on the Japanese Constitution and the practices and theories that have developed under it, with the aim of elucidating its distinctive features from a comparative perspective. The rich body of comparative constitutional scholarship that extends beyond this focus—most of which does not take Japan as its object of analysis—can be drawn upon as supplementary material.
