The trust is not so familiar in everyday life, but is widely used in financial transactions. The trust is also expected to play a useful role in our low-birth-rate and big-aging-population society.
The course objective is to learn how the trust has evolved and how it is actually used, and understand what the trust is.
The trust has been developed in common-law countries, and is so foreign in Japan's civil law system as it was once called "oil floating on water". But, that is where the conveniencde of the trust comnes in.
In this course, you will learn how unique the trust is.

信託を際立たせるものとして、信託法に従うと民法とは異なる結論を導き出すことができるということが挙げられます。民法、特に債権法と物権法、についての基礎的な知識があれば、この点がより理解しやすいと思います。
※ できるだけ分かりやすく説明しますので、基礎的な知識に自信がなくても大丈夫です。
信託は、ふだんの生活ではあまり馴染みがないものですが、金融取引において幅広く使われてきています。また、少子高齢化社会において役に立つことが期待されているものです。
この講義では、信託の歴史や実用例を通じて、信託というものを理解することを目標とします。

信託は英米の法体系の下で発展してきたもので、「水の上に浮かぶ油」と呼ばれるほど、大陸法系の日本では異質なものです。でも、そこに信託の便利さがあります。
