This lecture`s main target is ①What kind of legal problems in local autonomy exists. Moreover, this lecture`s last target are ②Student have be able to think how to settle a legal problem in the local autonomy which has formed in the past and present now, ③Student have be able to think how there should be local autonomy.
In a modern nation, local autonomy is indispensable system and existence to achieve resident's human rights and Democracy. However, our country was developing as the centralized government lengthily. Therefore various problems have also occurred there.
So, in this lecture, the important system prescribed by a local government law will be taken up. Specifically, student can get basic knowledge about what kind of right a resident possesses to a local government and what kind of authority each local government possesses. Then, I'd like to offer the motive which can think how there should be local autonomy on it. For example it's possible to give this a thing such as relations between a state and a local government, and relations between a local government and a resident.

地方自治法は、従来、行政法各論として位置付けられており、行政法１・行政法２を履修中・履修済であると、より効果的に学修が行えることになります。

本講義は、①地方自治を巡る法的課題としてどのようなものがあるのか、ということが主たる目標となります。その上で、②過去から現在まで生じている法的課題をどのように解決するべきかを受講生が考えられるようになっていただくこと、および、③地方自治はどうあるべきかを考えられるようになっていただくことが、最終的な目標となります。

地方自治は、現代国家において、住民の人権と民主主義を実現する上で不可欠な制度・存在となっています。けれども、わが国は長く中央集権国家として発展してきたということもあって、そこにはさまざまな障害も生じています。
そこで、本講義においては、地方自治法で規定されている重要な制度を取り上げることで、住民が各地方公共団体に対してどのような権利を有しているのか、そして各地方公共団体はどのような権限を有しているのか、といった基礎知識を養うことになります。その上で、国と地方公共団体の関係や地方公共団体と住民の関係といった地方自治はどうあるべきかを考えて貰えるきっかけを提供できれば、と思っています。
