【Course Objectives】

Through acquiring basic knowledge of legislative techniques, legislative content, and legislative process, students will understand the process of designing a legal system, assembling it into a proposed law, and enacting it as a law. Students will also acquire the basic ability to consider what kind of legal system should be designed as a means to solve various problems in Japan.

【Course Contents】

This is an introductory course in legislative studies.
Laws are constantly changing, with many new laws being enacted, amended, or repealed each year as a means of solving problems arising from changes in people’s lives and economic and social conditions. This lecture will focus on (1) the structure of laws and regulations, the terminology used to express individual articles, and other technical methods used to create laws and regulations (legislative techniques), (2) what legal policies are selected for what purposes and what structure of the legal system is established (legislative content), and (3) how laws are enacted by the government and the Diet from the drafting of proposed laws to their enactment (legislative process). The course will explain from three perspectives: (1) what kind of procedures and processes are followed by the government and the Diet from the drafting of a proposed law to its enactment (legislative process).
In order to actually draft laws and regulations, a sufficient understanding of the Constitution, Administrative Law, Local Autonomy Law, Civil Law, Criminal Law, etc. is a prerequisite, and knowledge of the target legal field is also necessary, so this lecture will focus on an overview of introductory matters that do not require these.
The subject matter will focus on national laws and regulations, but if possible, ordinances, local government regulations, etc. will also be discussed.
The lectures on (1) and (2) will provide basic knowledge for interpreting laws, particularly administrative laws, and will also be useful when students go into practice and prepare documents that establish some legal norms (rules), while (3) will deepen students’ understanding of the Diet and the administration among the governance structures established by the Constitution.
In addition to the above, any recent newspaper reports related to legislation and the Diet will be discussed, and the background, actual conditions, and issues will be outlined.
