【Course Objectives】

By the end of the course, students will be able to 1) establish the methods of studying jurisprudence, 2) write legal documents, with a view to taking the National Bar Examination of Japan.

【Course Contents】

In this course, we will study several cases with which the Constitution of Japan is related. For each case, two to three classes will be spared. A set of these two to three classes will be carried as follows:
(1) We will read the case in question.
(2) We will read some documents which may help to understand the case studied in Class (1), such as commentaries written by scholars or clerks (Judicial Research Officials of Supreme Court of Japan), and academic papers.
(3) We will have a discussion on a case example which is slightly different from the case studied in Class (1).
・In Classes (1) and (2), some students will be assigned to summarize a case or a document. Those students will be required to write a handout in advance and to make a presentation.
・Class (3) discussion will be based on reports written by students in advance.
・We may sometimes dispense with Class (2) or (3), according to the progress of the course.
・In Class (1), we may examine the adjudication of first instance to know the facts in detail.
