This course is designed for students interested in studying law-related topics in English, particularly those who are interested in having a general introduction to legal history and law, with an emphasis on the common law system. Moreover, this course might be a good option for those considering future participation in exchange programs or interested in the English-language Global Program from the Faculty of Law. Students will be introduced to studying in English in a manageable way. While the primary language of instruction is English, Japanese may also be used in class.
The main objectives of this course are twofold. First, to provide students with an introduction to legal studies in English in a supportive environment. Second, to introduce the history of law, different legal approaches, legal divisions, and how to analyze legal issues from different perspectives. By understanding the principles of legal thinking in English, students will develop critical and logical thinking skills relevant not only to their academic life but also beyond the university. This course aims to help students develop the critical thinking skills necessary to solve legal issues.
In summary, this course aims to help students:
a) Have a general introduction to law in English.
b) Gain basic legal knowledge of legal studies, especially legal history and the common law system.
c) Enhance critical and logical thinking skills.
The course begins with the history of law, tracing its development from Ancient Mesopotamia to the present. It then examines the rule of law and the distinctions between civil and common law systems. The course also covers statutory interpretation, focusing on how laws are understood and applied in practice. Finally, it introduces key areas of law, including contracts, torts, and criminal law, with an emphasis on common law jurisdictions.
Through the study of legal history, the rule of law, and the differences between civil and common law, students will gain an understanding of how legal systems have developed, with particular attention to common law. The course will cover the foundations and sources of law, the origins of legal institutions and reasoning, and current debates in key legal areas. If time allows, it will also address the role of courts and lawyers in Japan and internationally.
This is an introductory course and does not require prior legal knowledge.
The language of instruction is in English and for grade activities will be in English language as well. The instructor will seek to support students whose first language is not English.

本演習では、英語で法学を学ぶ意欲を持つことが求められます。
Students are encouraged to use a laptop or tablet during in-class tests. Those without access may request accommodation from the instructor.
授業内テストにおいては、ノートパソコンやタブレットの使用を推奨します。使用できない場合は、事前に担当教員へ申し出ることで、手書きによる回答を認めるなどの配慮を行います。
本演習は、英語で法学関連分野を学ぶことに関心のある学生を対象とし、特に法の歴史および法学の基礎について、コモン・ロー(英米法)を中心に概説することを目的としています。将来的に留学や交換留学を検討している学生、またはグローバルコース(法学部の英語プログラム)への参加に関心のある学生にとっても、有益な導入科目となります。学生が無理なく英語による学習に取り組めるよう配慮しながら授業を進めます。授業の主な使用言語は英語ですが、必要に応じて日本語も使用します。
本演習の目的は、大きく分けて二つあります。第一に、英語で法学を学ぶための基礎を、安心して学べる環境の中で提供することです。第二に、法の歴史、法の考え方、法分野の区分、そして多角的な視点から法的問題を分析する方法を紹介することです。
英語による法的思考の基本を理解することで、学生は大学での学習にとどまらず、将来にわたって有用な批判的思考力および論理的思考力を身につけることが期待されます。本授業は、法的問題を考察・解決するために必要な思考力の養成を目指します。
本演習を通じて、学生は以下の能力の習得を目標とします。
a) 英語による法学の基礎的理解を得ること。
b) 特に法の歴史およびコモン・ローを中心とした法学の基礎知識を身につけること。
c) 批判的かつ論理的に物事を考える力を高めること。

本演習は、古代メソポタミアから現代に至るまでの法の歴史を概観することから始まります。その後、法の支配(Rule of Law)の概念や、大陸法とコモン・ローの違いについて検討します。
さらに、制定法の解釈を取り上げ、法律がどのように理解され、実務においてどのように適用されるのかを学びます。最後に、契約法、不法行為法、刑法などの主要な法分野を、主にコモン・ローの視点から紹介します。
法の歴史、法の支配、そして大陸法とコモン・ローの相違について学ぶことを通じて、学生は法制度がどのように発展してきたのかを理解し、特にコモン・ローの特徴について知識を深めます。
本演習では、法の基礎および法源、法制度や法的思考の起源、主要な法分野における現代的課題についても扱います。時間に余裕がある場合には、日本および国際社会における裁判所や法律家の役割についても取り上げます。
本演習は導入科目であり、事前の法学知識は必要ありません。演習および成績評価に関わる活動は英語で行いますが、英語を母語としない学生に対しては、理解を支援するための配慮を行います。
The course begins with the history of law, tracing its development from Ancient Mesopotamia to the present. It then examines the rule of law and the distinctions between civil and common law systems.
