This course is designed for students interested in studying law-related topics in English, particularly those who are interested in social justice, criminal law, and international law. Moreover, this course might be a good option for those who are considering future participation in exchange programs or are interested in the Global Program from the Faculty of Law. Students will be introduced to studying in English in a way that is manageable and not overwhelming. While the primary language of instruction is English, Japanese may also be used in class.
This course aims to provide students with an introduction to some fundamental aspects of criminal law (mainly common law), both international and Japanese regulations concerning human trafficking (modern-day slavery), and the basic principles of international criminal law.
The objectives of this course are to help students:
a) have a basic understanding of criminal law in common law jurisdictions
b) develop skills to critically analyze key social and legal issues concerning criminal law
c) think about criminal law issues from a global perspective
d) have a basic understanding of international issues concerning criminal law
This course is suitable for students with no prior knowledge of criminal law. It is open to students of all backgrounds and majors who are interested in taking this seminar. Everyone is welcome.
The course will begin by introducing students to the fundamental definitions and concepts of a common law criminal system. While the primary focus is on the United Kingdom, students will also explore the criminal systems of other common law countries, such as the United States. The course will also address the Japanese criminal system. After providing a general overview of criminal law within the domestic legal system, the course will analyze its international aspects.
The seminar will initially focus on how to analyze criminal data to identify trends—specifically, which crimes are increasing and which are decreasing in both the United States and Japan. Next, the focus will shift to understanding how certain behaviors are classified as crimes and which actions should be considered criminal. The course will then cover the elements of a crime and provide insight into how to think like a criminal lawyer, particularly in assessing serious offenses like murder. This section will draw upon key interesting case laws from the United Kingdom and include practical analysis.
Subsequently, the seminar will focus on human trafficking as defined by the United Nations. Students will discuss the definition of human trafficking and examine key criminal issues related to it, such as forced labor and forced begging, among other crimes. Finally, the course will address the criminal justice system, exploring how it impacts individuals’ lives. It will also briefly consider the workings of international criminal law, with a particular emphasis on the International Criminal Court.
Class contents will include discussions of crimes and violations. Please be aware that sensitive topics will be discussed in class.
This course is an introductory seminar for anyone interested in studying law in English or those interested in going on exchange to an English-speaking university. Classes will be in English, but the instructor will accommodate those who are not confident in the language (discussions and questions can be in Japanese). No previous knowledge of criminal law or international law – or law in general – is necessary. Everyone is welcome to join and participate, regardless of their language, background, or legal knowledge.

この法学基礎演習は、英語で法学関連のテーマを学びたい学生、特に社会正義、刑法、国際法に関心のある学生を対象としています。また、将来的に交換留学プログラムへの参加を検討している学生や、法学部のグローバルコースに興味のある学生にも適した演習です。学生が英語での学習に取り組む際に負担が大きくならないよう、分かりやすく進めていきます。授業の主要言語は英語ですが、必要に応じて日本語も使用される場合があります。
本演習では、刑法(主に欧米法)、人身取引(現代の奴隷制度)に関する国際的および日本の規制、そして国際刑法の基本原則について学ぶための導入を提供します。

この演習では、まず「Common Law」の刑事法体系における基本的な定義と概念を学生に紹介します。主にイギリスの刑事法体系に焦点を当てますが、アメリカ合衆国など他のコモンロー諸国の刑事法体系についても学びます。また、日本の刑事法体系についても少しだけ取り上げます。国内法体系における刑事法の概要を学んだ後、その国際的側面についても分析を行います。
初めに、犯罪データを分析してトレンドを把握する方法に焦点を当てます。特に、アメリカと日本において増加している犯罪と減少している犯罪について検討します。次に、どのような行為が犯罪と分類されるのか、また、どの行為が刑罰に値するべきかについて理解を深めます。その後、犯罪の構成要件を学び、特に殺人のような重大犯罪を評価する際に、刑事弁護士の視点で考える方法を習得します。このセクションでは、イギリスの主要な判例を取り上げ、実践的な分析を行います。
続いて、国際連合が定義する人身取引(ヒューマントラフィッキング)に焦点を当てます。学生は、人身取引の定義について議論し、強制労働や強制的な物乞いなど、それに関連する主要な刑事問題を検討します。最後に、刑事司法制度が個人の生活にどのような影響を与えるかを探り、国際刑事法の仕組みについて簡単に触れます。特に国際刑事裁判所(ICC)に焦点を当てます。
