【Course Objectives】

This course aims to acquire the ability to correctly read and critically analyze judgments of Japanese domestic courts that are related to international law, taking consideration of related materials.

【Course Contents】

 Since international law basically governs relationship between States, courts that apply international law are mainly international courts such as the International Court of Justice (ICJ). For various reasons, however, there are many judgements of domestic courts where international law is involved.
 We will precisely read and deeply understand in this seminar some important judgments of Japanese domestic courts that are related to international law, including related materials (such as commentaries or academic papers). According to participants’ interest, we will choose subjects from such fields as sovereign immunity, international human rights law, postwar compensation, atomic bomb litigation (so-called Simoda Judgement), international economic law, international maritime law or international environmental law.
 In each class, two presenters will form one group and collectively make a presentation, followed by a discussion among all the participants. The group will make their presentations on two successive classes (two weeks), the first of which deals with the text of the judgment (and, if any, the impugned judgments of lower courts) and the second of which focuses on related materials. The two presenters are required to prepare enough for their presentation and designate appropriate related materials to make the discussion fruitful, while other participants are also required to read well enough to contribute to the discussion.
 This seminar is suitable for highly motivated students, such as those who are interested in international law or those who intend to take the bar examination.
