The objectives of this seminar are to examine the various problems in Civil Law while accurately understanding the positioning of those problems and to become able to derive your own ideas based on legal thinking. At the same time, this seminar aims to enable students to master the techniques which are required for learning and to become a member of society which include researching the literature, preparing as a group for a presentation and giving a report, and engaging in a debate based on a report.
In this seminar, we will consider various legal issues related to couples, with a focus on same-sex marriage.
Throughout the semester, I would like to examine the issue of same-sex marriage from various angles. We will also learn various prerequisites for understanding this problem. For example, it is necessary to understand what kind of effects are observed by being legally married, and it is also necessary to understand what effects are observed for couples outside of marriage and where the differences are. Additionally, hints about whether same-sex marriage will be approved may be hidden in the judgments that discuss the unconstitutionality of the system that forces married couples to have the same surname.
In this seminar, during each session two or three students will present a report on the relevant topic which will form the basis of discussion (each participant will give one reports during the semester). Moreover, the students giving the report will also present the arguments after the report to lead the discussion (the instructor may assist as needed). The instructor wishes to respect the autonomy of all students. Students are required to sufficiently prepare and actively speak up in discussion.
In addition, this seminar is scheduled to be a joint seminar with Professor Aya Osawa (Hosei University). In addition to preparing a report, you are invited to participate in either the question or the answer of the joint seminar.
Third and fourth year students can participate in this seminar. I will give as much consideration as possible to job hunting, so please actively participate.

民法に関するさまざまな問題点を検討しながら，問題の正確な位置づけを把握し，法的な思考に基づいて自分の考えを導くことができるようになることを目指します。それとともに，文献を調べる，グループで発表の準備をし報告をする，報告に基づき討論するといった，学問をする上でも社会に出る上でも必要な技術を習得することを目指します。

このゼミでは，同性婚の問題を中心としつつ，さまざまなカップルに関する法的な問題を考えます。
1学期を通じて，同性婚の問題をさまざまな角度から検討したいと思っています。この問題を理解するためのさまざまな前提知識についても学んでいきます。たとえば，法律上の婚姻をすることにより，どのような効果が認められるかを理解する必要がありますし，婚姻外のカップルにどのような効果が認められており，差異がどこにあるかも理解する必要もあります。また，夫婦同姓制度の違憲性を論じる判決文の中に，同性婚が認められるかのヒントが隠されていたりもします。
さまざまな分析を通じて，唯一の答えを導きだすことを目指している訳ではありません。最終的に目指すのは，このテーマを通じて何を議論すべきなのか，社会に問うべき問いを提示することです。
このゼミでは, 毎回2－3名の報告者が該当テーマに関する報告を行い, それに基づいて討論をします (各参加者は, 学期中に1回報告することになります) ｡ また, 報告後の討論の司会をする, つまり論点を提示するのも報告者です (教員が必要に応じて手助けをします) ｡皆さんの自主性を重んじたいと思っています｡ 十分な予習, 積極的な発言が求められます｡
また，このゼミでは，法政大学・大澤彩先生のゼミとの合同ゼミを予定しています。報告の準備に加えて，合同ゼミの作問か解答，いずれかに参加してもらいます。
配当年次は3‐4年となっています｡ 就職活動についても，できる限り配慮します。3・4年生も積極的にご参加ください。
