Students will deepen their understanding of key themes covered in criminal law general part, develop the ability to comprehend case law and foundational academic papers, and gain the capacity to independently research and synthesize information on topics of personal interest.
The general part of criminal law is highly abstract, and many students find it challenging. This seminar aims to deepen understanding of these principles by examining key issues through case studies and fundamental academic papers.
The first half involves reading and discussing foundational academic papers to enhance comprehension. In the latter half, drawing on the discussions from the first half, each participant will research and summarize a court case or key issue that interests them. They will then present their findings and engage in discussion with the group.

刑法総論の成績は考慮しません。刑法は苦手だがなんとなく勉強し議論してみたいという学生も歓迎します。
刑法総論で取り扱われている重要なテーマについての理解を深めるとともに、判例や基礎的な学術論文を理解できる能力を養い、自身で関心のあるテーマについて自身の力で調べまとめることができるようになる。

刑法総論は極めて抽象度が高く、苦手とする学生も多いと思われます。本演習では、総論において重要だと考えられる問題を取り上げ、判例や基礎的な学術論文の検討を通じて、刑法総論についての理解を深めることを目的とします。
前半は、基礎的な学術論文を輪読し、参加者で議論することで理解を深めていきます。後半では、前半での議論を参考にして、参加者各々が、自身が興味を持った判例や重要論点について調査を行い、まとめたうえで報告を行い、参加者と議論をします。
