【授業の目標 / Course Objectives】

　裁判例・学説等の分析を通して知的財産法に関する理解を深める。併せて、プレゼンの能力や、ディスカッションを充実したものにするための力を養う。

　The objective of this seminar is to deepen the students’ understanding of Intellectual Property Law through an analysis of court precedents and theories, etc. At the same time, it will also cultivate the students’ abilities to give presentations and engage in thorough discussions.

【授業の内容 / Course Contents】

　参加者には、指定する裁判例を、関連する学説・裁判例や時事問題も含めて調査した上で、グループ発表を行ってもらいます。知的財産法は、エンターテイメント、デザイン、技術、ブランド、営業秘密といった、様々な分野に関わる法領域ですが、今年度のゼミは、ブランドに関わる商標法と、技術に関わる特許法に焦点を当てます（来年度は、不正競争防止法と著作権法を扱う予定です）。報告者の人数や報告回数等は、参加人数や各自の関心を考慮して後ほど決定します。
　報告の後に、参加者全員で議論を行います。議論の形式は報告者に任されますが、最近はグループディスカッションを交えた形を採ることが多いです。
　演習を充実したものにするためにも、報告者・報告者以外の参加者ともに相応の準備が求められます。報告者には、本報告の一週間前に、プレレジュメによって、報告内容の簡略な予告と最低限の参考文献の指定を行ってもらいます。報告者以外の参加者には、指定された裁判例を事前に読み、プレレジュメを参考に当該テーマについてある程度理解を深めた上で本報告に臨んでもらいます。
　なお本演習は、知的財産法の講義を受講中又は受講済みの方以外でも、知識の不足を補うに足る熱意を持った方であれば、参加可能です。議論を楽しいものにするためにも、多様なバックグラウンドや関心を持った皆さんの参加を期待しています。

　Participants will give group presentations after researching the specified court precedents including related theories, precedents, and current topics. Intellectual Property Law is an area of law which is involved with various fields such as entertainment, design, technology, branding, and trade secrets, but the seminar during this academic year will focus on Trademark Law involving brands and Patent Law involving technology (the seminar during the following academic year is scheduled to cover the Unfair Competition Prevention Act and the Copyright Act). The number of presenters and the number of reports will be decided later based on the number of participants and in consideration of individual interests.
　After the reports, all participants will engage in a discussion. The discussion format will be left up to the presenters, but recently many students adopt a format which mixes in group discussion.
　In order to make it a productive seminar, presenting students as well as other participants are required to carry out a suitable level of preparation. One week before a report is given, the presenters will provide a brief preview of the report content and specify the minimum reference literature through a pre-summary. Participants who are not presenting will read the specified court precedent in advance and attend the report presentation after deepening their understanding of the relevant topic to a certain degree by referring to the pre-summary.
　Furthermore, please note that students who are not currently taking or have not previously taken a lecture on Intellectual Property Law may participate in this seminar if they have the enthusiasm to make up for their lack of knowledge. To make the discussions more enjoyable, it is hoped that students with a diverse range of backgrounds and interests will participate.
