This exercise aims to provide an in-depth study of the special part of criminal law from the perspective of “family and criminal law.” It draws primarily on case law and judicial precedents concerning legal issues that arise within family relationships, focusing on the specific offenses enumerated in the Special Part of the Penal Code—such as crimes against life and bodily integrity (especially homicide), crimes against personal liberty (including unlawful confinement and abduction), and crimes against property (such as robbery and fraud)—so that participants can gain a deeper understanding of these provisions through the lens of family contexts.
This exercise presupposes a thorough grasp of established criminal law doctrine and seeks to explore innovative approaches to resolving issues in the special part of criminal law that emerge from the diverse factual patterns arising within family relationships.
For instance, where one spouse steals property belonging to the other, the special provision for theft among relatives under Article 244(1) of the Penal Code results in mandatory exemption from punishment. Yet can this consequence invariably be deemed appropriate? Likewise, when a parent inflicts corporal violence on a child in the name of “discipline,” is the offense of assault always established? As these examples illustrate, scenarios involving family members can assume a wide array of forms.
Accordingly, this exercise will draw on actual case laws and judicial precedents in which such matters have been contested, while critically examining appropriate resolutions within the framework of the special part of criminal law.

①題目：刑法総論又は各論の判例・裁判例を一つ選択し、自分がなぜその判例・裁判例に関心を有したのかを明示しつつ、その判例・裁判例の理由付けや結論に対してどのように考えるかについて、自由に記述して下さい。
②字数：1000字～1500字程度
演習論文／Seminar papers：実施しない
この演習は、家族において生じる法的問題を巡る刑法各論の判例・裁判例を基にして、主として刑法典における各則における罪、例えば殺人罪を中心とする生命・身体に対する罪、監禁罪や拐取罪を中心とする自由に対する罪、強盗罪や詐欺罪といった財産に対する罪などにつき、「家族と刑法」という視点を基に、より深く学ぶことを目標とする。

本演習では、家族をめぐって生じる様々な事例が提起する刑法各論における問題を解決するために、従来の刑法における議論を十分に理解することを前提に、新たな解決の可能性を検討したい。
例えば、配偶者の一方が他方の財産を侵害する場合には、親族相盗例が適用されることにより、その刑が必要的に免除される（刑法244条1項）。しかし、こうした帰結が常に妥当であると言えるのであろうか。また、親が子に対して「しつけ」の名の下で行う暴行は、暴行罪の成立が常に認められるのであろうか。このように、家族をめぐって生じる事例は様々な形で想定可能である。
この演習では、このような事案が現実に問題とされた判例・裁判例を題材としつつ、刑法各論における解決方法を考えていくことにする。
