【授業の目標 / Course Objectives】

この演習は、私たちの日常生活における多様な情報・コンテンツに介入して規制する刑法について認識し、どのような問題を刑罰・刑事的制裁によって解決するのかが妥当であるのか（なぜ刑罰を用いて解決する必要があるのか）について学ぶことを目標とする。

This exercise aims to foster an awareness of how criminal law intervenes to regulate the diverse forms of information and content that permeate our everyday lives, and to critically examine whether—and if so, why—such issues warrant resolution through penalties or other forms of sanction.

【授業の内容 / Course Contents】

情報・コンテンツの自由な流通は、我々の社会の基底をなすものであり、表現の自由によって憲法上厚く保障されている。しかし、他方において、著作権や名誉を侵害するコンテンツ、性的な内容を有するコンテンツといった多様なコンテンツにつき、様々な形で刑事的な規制がなされており、その当否や限界が大きな問題となる。
例えば、著作権法に関して言えば、著作権侵害がいかなる場合に認められて刑罰の対象となるのか、過度に広汎な処罰とならないか、といった点が重要な検討課題となる。
また、名誉に関して言えば、表現の自由と名誉の保護の調整が刑法230条の２との関係で従来問題とされているが、近時は、オンラインにおける誹謗中傷といった、インターネットにおいて特に顕在化する名誉侵害表現の規制のあり方が大きな問題となっている。
さらに、性的なコンテンツについても、わいせつ情報や児童ポルノの刑事的規制は、表現の自由との関係で重大な問題を提起する。
本演習では、このような表現行為に対する刑事的規制の当否を正面から扱い、その問題点や今後のあるべき立法論も含めた検討を行うことを予定している。

The free circulation of information and content forms the foundation of our society and is robustly protected under the constitutional guarantee of freedom of expression. At the same time, however, a wide range of content—such as that infringing copyright, harming reputation (slander and libel), or containing sexual elements—is subject to various forms of criminal regulation. The propriety and limits of such regulation have emerged as major issues of debate.

For instance, in the realm of copyright law, critical questions arise concerning the circumstances under which copyright infringement becomes subject to criminal penalties and whether such punishment risks becoming excessively broad.

With respect to reputation, the traditional tension between freedom of expression and the protection of honor has long been addressed in relation to Article 230-2 of the Penal Code. In recent years, however, the focus has shifted markedly toward the regulation of online defamation and cyberbullying—forms of reputational harm that have become particularly acute in internet environments.

Furthermore, criminal restrictions on sexual content, including obscene materials and child pornography, continue to raise significant issues in relation to freedom of expression.

This exercise will directly confront the legitimacy of criminal regulation directed at expressive conduct. It will examine the underlying problems and consider desirable directions for future legislation.

【授業時間外（予習・復習等）の学修 / Study Required Outside of Class】

原則として全員が最低1回ずつ報告を担当することになるため、担当回に向けての事前準備等が欠かせない。また、各回の報告に対する活発な質疑応答のため、事前に配布される資料やレジュメについて予習することが不可欠となる。
また、この演習で扱うテーマは、学部の刑法（１）・（２）では履修しないものもあり、履修対象であっても十分に講義においては扱われないものも多い。しかし、基本的な刑法総論及び各論の知識は必須となるため、なるべく刑法（１）・（２）を履修すること（または履修予定であること）が望ましい。
日頃から刑法のみならず多様な問題について関心を持ち、積極的に学習する学生の参加を希望する。
