The purpose of this seminar is to deepen students’ understanding of the law of criminal procedure and acquire the skills for collecting and organizing materials, understanding their contents accurately, conveying them properly to others, and engaging in constructive discussions.
In this seminar, we will revisit the fundamental aspects of criminal procedure law to discuss theoretical issues—what the core problems are and how they should be resolved—as well as the future direction of legal regulations. For each session, a presenter will be assigned. Presenters will research their assigned topic, summarize their findings in a presentation outline, and report on them. Following each presentation, all participants will engage in a discussion about the content.

参加人数によりますが、ゼミの前半は2人以上のグループで共同報告をしてもらい、ゼミの後半は個人での報告に挑戦してもらうことを計画しています。最初から上手な報告ができる必要はなく、場合によっては追加報告等もしてもらいつつ、自分が調べたことを上手に相手に伝え、建設的な議論をする、という技術を身につけてもらえればと思います。
とはいえ、調査報告者には、自分が担当するテーマについて、図書館やデータベース等を利用しながら、関連する文献を収集し調査してもらいます。テーマによっては、報告のヒントとなる文献や判例を教員が示す場合もありますが、いずれにせよ、報告者は、報告のために、授業外の時間を一定程度費やさねばなりませんので、その点はご留意ください。
報告者以外の履修者も、議論に積極的に参加することが期待されます。そのために、報告者のレジュメや参考文献に事前に目を通しておく、といった予習が必要になる場合もあります。
なお、「刑事訴訟法」の授業を履修済みであることが望ましくはありますが、そうでない方でも、ゼミに積極的に参加する意欲さえあれば、それで、最後まで全く問題はありません。

刑事訴訟法についての理解を深めるとともに、資料を収集・整理して正確に理解し、それを的確に相手に伝え、建設的な議論をする能力を身につける。
The purpose of this seminar is to deepen students’ understanding of the law of criminal procedure and acquire the skills for collecting and organizing materials, understanding their contents accurately, conveying them properly to others, and engaging in constructive discussions.
この演習では、刑事訴訟法に関する基本的な問題を幅広く取り扱って、検討します。
刑事訴訟法に関する基本的な問題、というと、やや堅苦しく聞こえますが、警察の人が被疑者の人を逮捕した、とか、〇〇氏が起訴された、といったように、刑事訴訟法に関連する話題は、日々のニュースの中に溢れています。最近では、人質司法に対する批判や再審に関する法改正といった話題も取り上げられることが多く、刑事訴訟法に関するニュースを耳にする機会はますます増えているでしょう。
本ゼミでは、こういった刑事訴訟法に関する事柄について、その基本部分に立ち返って、一体何が問題なのか・どのように解決していくべきかという、理論的な問題点・今後のあるべき法的規律を議論します。
各回について、報告者が割り当てられ、報告者になった人は、担当するテーマについて調査を行い、その結果をレジュメにまとめて報告します。報告終了後は、報告内容について、履修者全員で議論を行います。
