This course aims for students to learn about the relationship between society and law, with a focus on studying Civil Law judicial precedents and cases, while becoming able to think legally about daily societal events. Furthermore, students hone their oral skills by giving presentations.
This seminar will carefully examine the concept of civil code, understanding of facts, etc. using court reporters' reports as materials. We also plan to learn how the law impacts our lives through the following content.
(1) Precedent research and case studies
The seminar focuses on the examination of Supreme Court precedents related to civil code and on civil code case studies, which are selected and reported on by the participants. Please refer to the seminar in the 2024 academic year, which dealt with the following cases.
"Civil Code from the Perspective of Contracts", "Real Estate Transactions and Civil Code", "Lease Contracts and Civil Code", "Torts and Civil Code", "Families and Civil Code", and "Learn about Law of Securities".
Depending on the number of seminar participants, as a general rule, each participant will individually present case reports and case studies at least once a year. Group presentations may be held if there are many participants.
(2) Discussions with guest speakers
We plan to have lawyers and other legal practitioners and corporate executives speak on how the law is used in their corporate activities and personal lives and hold discussions with seminar participants. (There are one or two guest speakers in a typical year.)
(3) Observation of trials
Participants are scheduled to study court proceedings by observing actual trials (in past years, students have observed civil and criminal trials).
We hope that students who actively express their views will participate since the discussion will be the focus of the seminar and the discussion will be premised on the idea that "there are no mistakes in the theory of legal interpretation". Participants also will be asked to prepare questions and reports when guest speakers come and to prepare reports after observing trials.
Credit will be assessed on the basis of attendance, class participation, and reports.
The content of classes may be modified as needed. In addition, consideration will be given to the extent possible with respect to job searching, Teacher Training Courses, and the like.

＜選考方法＞

①題目：以下の内容を全て含めて作成すること
【１】自己紹介（本演習の志望動機＋大学生活で真剣に取組んでいる活動（学内外を問わず）の紹介）
【２】民法判例百選掲載の判例（但し、平成元年以降の判例）から、関心を抱いた判例の紹介及びその判例を選択した理由（選択した判例を、ゼミで発表してもらうことがある）。なお、判例を紹介するに当たっては、判例の年月日と出典を記載すること（例：最判平成10年4月30日・判タ980号101頁）
②字数： A4用紙1枚以内（字数制限なし）
演習論文：実施しない
民法の判例や事例の勉強を中心に、社会と法律の関わりを学ぶとともに、日々生ずる社会事象に対し法的思考ができるようになることを目標としている。また、発表を通してプレゼンテーション能力を身につける。

レポーターの報告を題材に、民法の考え方や事実の把握等を丁寧に考察する。また、法律が私たちの生活にどのような影響を及ぼしているかを知るために、以下の内容を予定している。
【1】判例研究及び事例研究
ゼミ員が選択して報告する民法に関する最高裁判例の検討及び民法に関する事例研究が、ゼミの中心となる。なお、2024年度の演習では、下記の事例を扱ったので参考にされたい。
【契約から見た民法】、【不動産取引と民法】、【賃貸借契約と民法】、【不法行為と民法】、【家庭と民法】、【担保について学ぼう】
ゼミ員の人数にもよるが、原則として、単独で判例報告及び事例研究を年１回以上、発表する。人数が多い場合、グループ発表を行う場合もある。
【2】ゲストスピーカーとの議論
弁護士等の法実務家や会社経営者に、法律が企業活動や個人の生活でどのように利用されているかについて語ってもらい、ゼミ参加者と議論してもらうことを予定している（例年、1～2名のゲストスピーカーにお話しいただいている）
【3】裁判傍聴
実際の裁判を傍聴し、裁判手続を勉強することを予定している（例年、民事裁判及び刑事裁判を傍聴している）。
議論がゼミの中心となり、議論では「法律解釈論に誤りはない」との考えが前提となるため、積極的に発言をする学生の参加を期待する。また、ゲストスピーカーが来られたときは、質問事項やレポートを作成してもらうほか、裁判傍聴後にはレポートを作成してもらう。
単位修得は、出席・発言・報告で評価する。
なお、授業内容は、必要に応じて変更することがある。また、就職活動、教職課程など可能な範囲で配慮する。
