To cultivate the ability to critically analyze judicial decisions and academic writings in civil procedure law
This seminar is designed for participants who already possess a basic understanding of civil procedure. Its objective is to deepen and refine that understanding through close and critical readings of judicial decisions and academic writings in the field of civil procedure.
In the spring semester, one important judicial decision in civil procedure law will be taken up in each session, primarily Supreme Court decisions.
In the fall semester, one recent and noteworthy academic article in the field of civil procedure law will be examined in each session.
In both semesters, the designated presenter will deliver a presentation of approximately 40 minutes, followed by a discussion involving all participants.

民事訴訟法に関する基本的な知識を有していることが最低限の前提となる。
民事訴訟法の判例・論文を批判的に読解する能力を涵養する。
To cultivate the ability to critically analyze judicial decisions and academic writings in civil procedure law
参加者が民事訴訟法についてすでに一定の知識を有しているを前提に、民事訴訟法に関する判例・論文の精読を行う。春学期には、民事訴訟法に関する重要な最高裁判例を毎回1つ取り上げて、批判的に検討する。秋学期には、民事訴訟法学に関する近時の注目される論文を毎回1つ取り上げて、批判的に検討する。いずれとの関係でも、指名された報告者が40分程度の報告を行い、その後、参加者全員で議論をすることになる。
