The objective of this class is to deepen understanding of Japan's Antimonopoly Act through the examination of precedents, which also strengthening fundamental legal reasoning skills and the ability to analyze judicial decisions.
The seminar examines important precedents concerning the major categories of regulation under the Antimonopoly Act: merger control, regulation of unreasonable restraints of trade, regulation of private monopolization, and regulation of unfair trade practices. A student gives a presentation about a precedent designated in advance, then all participants will discuss. Where necessary, the instructor may also present issues and ask students to consider them.

独占禁止法に関する基礎的な知識があることが望ましい。経済法の単位を取得していることは必要ではないが、独占禁止法を学習したことがない場合には、並行して学習することが推奨される。
日本の独占禁止法の先例の検討を通じて、独占禁止法に関する理解を深めるとともに、基礎的な法的思考力や判例分析能力を強化することを目標とする。

独占禁止法の主要な規制類型である企業結合規制、不当な取引制限の規制、私的独占の規制、不公正な取引方法の規制の重要な先例について検討する。事前に指定された先例について報告者が報告をし、参加者全体で議論する。必要に応じて、教員から問題を提示して受講者に考えてもらう場合もある。
