The aim of this course is to develop students' knowledge of tort law, their ability to think in legal terms, and their presentation skills through debates on tort law.The course also aims to improve the drafting skills of those who wish to become legal professionals.
Judicial precedents are often explained in lectures with large numbers of students, but in many cases, when you read the actual judicial precedent, you will become aware of case backgrounds that are completely different from what was described in the lecture. In order to provide a more in-depth study of actual cases that cannot be adequately studied in large lectures, this seminar will focus on the tort cases listed in the Top One Hundred and 30 Judicial Precedents series and will divide students into the roles of plaintiff and defendant for discussion.
The seminar will be conducted in such a way as to enable students to deepen their knowledge of tort law in a phased manner by holding study sessions led by the lecturer beforehand, holding the debates and holding a review session the following week to deepen students' knowledge. In addition to acquiring a basic knowledge of tort law, the aims of this seminar are to cultivate flexible thinking, the ability to present theories in a persuasive manner, and the ability to understand and evaluate another person's remarks in a logical manner. Correcting arguments can also help students improve their legal writing skills of future lawyers. In addition to debates, this seminar will include extra-curricular activities such as seminar trips, visits to law firms and companies, and discussions with other universities. Optional interviews will be held for students wishing to attend the seminar, so please make an appointment by email.

不法行為に関するディベートを通じて、不法行為法の基礎知識、法的思考能力、プレゼンテーション能力を養う。法曹志望者の答案作成能力の向上も目的とする。

大人数講義では、しばしば判例についての説明が行われますが、実際の判例を読んでみると、講義で聞いたのとはまったく違う事件の背景を知ることがよくあります。このゼミでは、大人数講義では十分に学ぶことのできない実際の事件についてより深く勉強するために、主に百選や判例30！シリーズに掲載されている、不法行為法に関する判例を取り上げて、原告側対被告側に分かれてディベートを行います。
進行方法としては、不法行為法に関する知識を段階的に深められるように、教員による事前学習会を経たうえで、ディベートを行い、翌週に検討会を行って知識を深めます。履修を通じて、不法行為法の基礎知識のほか、柔軟な思考力、自説を説得的に論証する能力、他人の話を理解して論理的に判断する能力を養うことを目標としています。また、立論の添削により、法曹志望者の答案作成能力を向上させることもできます。ディベート以外にも、ゼミ旅行、弁護士事務所や企業への訪問、他大学との討論会などの課外活動も行っています。演習参加希望者には、任意の面談を実施しますので、メールでアポイントをとって下さい。
