In modern medicine, drugs (pharmaceuticals) play a significant role both in the quality of medicine and quantity of medical expenditure, although laws on physician-patient relationships or laws on end-of-life seem to represent “medical law.” This seminar aims to analyze legal policies on medicine through the lenses of laws relating to drugs in the U.S. and Japan.
On the topics specified in each class, students will understand the current regulations in the U.S. and Japan and discuss the surrounding problems.
Students are required to read the materials (court cases, excerpts of textbooks, articles) in advance and discuss legal issues in class. Reading materials on American law are in English and those on Japanese law are in Japanese. Lectures and discussions in class will be in Japanese.

医療に関する法というと医師・患者関係に関する規律や終末期医療といったテーマに関する法が想起されるが、現代の医療において医療の質及び医療費の額のいずれの点からも大きな重要性を占めるのは実は「医薬品」である。本ゼミでは、医薬品・医療技術にまつわるアメリカ及び日本の規律について理解し、議論することで、医薬品を通して医療に関する法政策を検討することを目的とする。

各回に設定されたテーマ（トピック）につき、アメリカにおける法規律を中心としつつ、日本における法規律を比較として参照しながら現状の規律を確認するとともにあるべき規律を検討し議論する。
学生は各回のテーマに関して配布される資料（判例、教科書抜粋、論文等）を事前に講読したうえでゼミに参加し議論を行う。アメリカに関する文献は英語文献、日本に関する文献は日本語文献である。教員からの説明や学生同士の議論は日本語で行う。
