The application of scientific technologies involves risks due to their inherent uncertainty. This seminar will focus on important issues and aim to help students understand how the laws in the U.S. and Japan regulate such technologies, balancing risks and benefits and provide remedies when the risk materializes as harm.
In this seminar, students will discuss legal issues in auto-driving, the development of pharmaceuticals, the use of genetics, the use of nuclear energy, and telecommunications through reading the U.S. and Japanese cases and articles (Reading materials on the U.S. issues are primarily in English).
Students will have group discussion as well as discussion in the whole class.

科学技術の社会への応用は便益をもたらすとともに、その不確実性ゆえのリスクを孕む。本ゼミでは、いくつかの代表的なトピックを取り上げて、アメリカ及び日本における法が、そのようなリスクと便益をいかに衡量して規律し、リスクが現実化した際の救済をいかに行っているかについて理解することを目標とする。

This seminar will focus on important issues and aim to help students understand how the laws in the U.S. and Japan regulate such technologies, balancing risks and benefits and provide remedies when the risk materializes as harm.
今回のゼミでは、自動運転、医薬品開発、ゲノム情報の利用、原子力の利用、情報通信サービスという５つの分野における科学技術の利用とその法的規律について、日本及びアメリカの判例及び文献を用いて議論する（アメリカの文献については原則として英語文献となる）。
学生はグループに分かれて議論を行うとともに、ゼミ全体での議論も行う。
