【Course Objectives】

To undertand functions and roles of alternative dispute resolution (ADR), including negotiation, mediation and arbitration, as a means of dealing with civil and commercial disputes, and to discuss and obtain a better understanding regarding the practical operation and issues of ADR.

【Course Contents】

This course will focus not only on providing an outline of ADR system, including negotiations, mediation, and arbitration, but also discussing based on specific cases, from a practical perspective, (i) relationship between ADR and litigation and (ii) practices of dispute resolution.
The classes are basically scheduled to be conducted in an interactive manner. Particularly, when we deal with specific cases, a debate will be held. The order and the content of each class may be changed according to the progress of the classes. In addition, for each class, students will be asked to prepare and submit a memo that briefly describes their questions, observations and opinions.
