To undertand functions and roles of alternative dispute resolution (ADR), including negotiation, mediation and arbitration, as a means of dealing with civil and commercial disputes, and to discuss and obtain a better understanding regarding the practical operation and issues of ADR.
This course will focus not only on providing an outline of ADR system, including negotiations, mediation, and arbitration, but also discussing based on specific cases, from a practical perspective, (i) relationship between ADR and litigation and (ii) practices of dispute resolution.
The classes are basically scheduled to be conducted in an interactive manner. Particularly, when we deal with specific cases, a debate will be held. The order and the content of each class may be changed according to the progress of the classes. In addition, for each class, students will be asked to prepare and submit a memo that briefly describes their questions, observations and opinions.

民事・商事紛争を処理するための手段として、交渉、調停、仲裁等の裁判外紛争解決手続（ADR）の機能・役割を理解するとともに、法律実務におけるADRの運用や課題について検討し、理解を深めます。
To undertand functions and roles of alternative dispute resolution (ADR), including negotiation, mediation and arbitration, as a means of dealing with civil and commercial disputes, and to discuss and obtain a better understanding regarding the practical operation and issues of ADR.
交渉、調停、仲裁等のADRの制度の概要を解説するだけでなく、ADRと裁判手続との関係及び紛争解決手続の実務について、具体的な事例に基づき、実務的な観点から検討します。授業は、基本的に双方向型で実施することを予定しており、特に、具体的な事例に基づく検討にあたっては、ディスカッション形式も用いつつ、進めたいと考えています。なお、授業計画は、講義の進捗状況に応じて、順番の入れ替え等の調整を行う場合があります。 また、毎回の授業毎に、質問、感想、意見等を簡単に記載するメモを作成してもらいます。

・民事・商事に関する紛争の解決方法に関心のある方
なお、日本の民事訴訟法の基礎的な知識があると望ましいものの、必須ではありません。また、国際調停等クロスボーダーの紛争解決方法についても触れますが、本演習において英語で読み書きすることは想定していません。
