In this seminar, students will learn about the objects of protection of intellectual property law, including patent law, design law, copyright law, trademark law, unfair competition prevention law, and geographical indication law, and by understanding the differences in the protection of these objects of protection in Japan, the US, and Europe, students will develop the basic knowledge to become intellectual property law legal practitioners in the global market. Students will develop their reasoning skills by understanding and discussing the reasons and policy objectives for providing protection for each type of intellectual property right.
This seminar will examine the problems with the current intellectual property system and discuss possible solutions. Each time, several students are chosen in advance to present the content of cases or academic papers. Other students also read the judgement or paper in advance and prepare to discuss the issues. Through discussion, students will learn how to analyze legal issues. By analyzing issues of interest, proposing improvement measures, and answering questions from the lecturer and classmates, students will acquire the ability to explain their analysis and arguments in a logical manner. At the end of the seminar, students will choose a case dealing with IP rights and give a presentation analyzing the policy in the case and its impact on related policies and industry.

このセミナーでは、特許法、意匠法、著作権法、商標法、不正競争防止法、地理的表示法等の知的財産法の保護対象を学び、これらの保護対象の保護の日米欧の違いを理解することで、学生がグローバル市場における知的財産法法曹実務家となる基礎知識を養う。各知的財産権の対象に保護を与える理由と政策目的を理解し、議論することで論理的思考を育てる。

このセミナーでは、現在の知的財産制度の問題点を特定し、解決策について議論する。毎回、事前に数名の学生が選ばれ、判決や論文の内容を発表する。他の学生も判決や論文を事前に読み、問題点について議論する準備をしてくる。議論を通じて、法的問題を分析する方法を学ぶ。興味のある問題を分析し、改善策を提案し、講師やクラスメートからの質問に答えることで、分析や主張を論理的に説明できる能力を習得する。最後に、学生は知財判決を選び、判決の内容と関連する政策と産業界への影響を分析する発表を行う。
