民法の諸テーマについて、日本法と東アジア（主に韓国、他に中国、台湾など）法を比較し、双方の法と社会について理解を深めること
The aim of this course is to promote better understanding of civil law and society in Japan and east Asia
19世紀末にヨーロッパの民法典などを参考にしながらつくられた日本の民法典は、その後、判例・学説・立法などによりさまざまな変化を経て、現在に至っています。このようにヨーロッパ由来の民法典を参考に自国の民法典をつくり、それを展開させていくことで自国における私人間の法関係を規律している国は、日本だけではありません。近隣の国を例にとると、韓国も、台湾も、中国も同じようなプロセスを経ています。そして、これらの国の法ルールやそれにより規律される社会のあり方は、同じ東アジアの中でも様々に異なっています。この演習では、民法のいくつかの具体的なテーマを取り上げ、日本と東アジアの民法を比較しながら、近隣のこれらの国の何が同じで何が違うのかを探求することを通じ、これらの国の法と社会について理解を深めることを目標とします。このゼミでは、留学生の参加を歓迎しており、ゼミを通じて学生間の交流を深めることも目標の一つです。
具体的テーマは受講生と検討の上で決定する予定ですが、不動産の賃貸借（韓国、中国）、離婚後の親子関係（韓国、台湾）、同性婚（台湾）、約款にもとづく取引（中国）、相続人間の法律関係（韓国）などのテーマを考えています。
講義の具体的なテーマは第1回目の授業の際に決定するので、受講者は必ず第1回目の授業に出席してください。
なお、この授業は大学院との合併で行われる授業です。予習についてもしっかりと行うことを要件としますので、やる気のある学部学生のみ参加してください。
