The Constitution of Japan is the supreme law of Japan, which sets forth the governing organization, the governing actions, and the guarantee of rights of the nation. Although the Constitution of Japan has never been revised since its enactment, its portrait has been dynamically changing through constitutional interpretation. In this course, we will reveal the current portrait of the Constitution of Japan, focusing on these changes, and aim to acquire basic knowledge of the Constitution of Japan.
We will discuss the history of the establishment of the Constitution of Japan, the legal structure of the national governing system, and the guarantee of fundamental human rights in a concrete context in light of the current situation. The first five sessions will be spent on the general theory of the Constitution, and the sixth and subsequent sessions will focus on each theory of the Constitution.

憲法は，国家の統治組織・統治作用や権利保障のあり方を定めた日本の最高法規です。日本国憲法は制定以来，一度も改正されていないものの，その姿は「憲法解釈」を通じてダイナミックに変化しています。この講義では，そうした変化に着目しながら現在の日本国憲法の姿を示し，日本国憲法に関する基本的な知識の修得を目指します。

日本国憲法成立の歴史，国家の統治機構の法的構造，基本的人権保障のあり方などを，現在の状況とも照らし合わせながら，具体的な文脈の中で論じていきます。第1回から第5回で憲法総論を取扱い，第6回以降で憲法各論を取り扱う予定です。
