The objective of this class is to examine legal issues related to interrogation and confessions. Students will deepen the understanding of the criminal justice system in Japan.
You can probably imagine the scene where the police interrogate a suspect to obtain a confession. This type of investigation is widely used in Japan. But if the interrogation is conducted improperly, there is a risk of violating the human rights of the suspect or creating a false confession.
It has been pointed out that the excessive dependence on the interrogation and the confession obtained through the interrogation is a persistent problem of the criminal justice system in Japan. There is also a criticism that the criminal justice system in Japan is a "hostage justice" system.
Even if one takes a critical stance toward the criminal justice system in Japan, it is necessary to understand its actual situation accurately. This course will provide students not majoring in law with basic knowledge about interrogation and confessions, and allow them to think about the Japanese criminal justice system on their own.

取調べと自白に関する法的問題点を検討し，日本の刑事司法に対する理解を深める。
The objective of this class is to examine legal issues related to interrogation and confessions. Students will deepen the understanding of the criminal justice system in Japan.
警察が被疑者に対する取調べを行い，自白を獲得するという光景は，みなさんもイメージすることができるのではないかと思います。このような捜査手法は，日本で広く用いられているものですが，自白を獲得しようとするあまり，捜査機関が不適切な方法で取調べを行えば，被疑者の人権を侵害したり，虚偽の自白を生み出してしまう危険もあります。
これまで，取調べやそれによって獲得される自白調書に過度に依存してしまっていることが，日本の刑事司法の宿根的な問題であると指摘されてきました。また，日本の刑事司法制度は「人質司法」であるという批判も存在します。
ただ，仮に日本の刑事司法制度に対して批判的な立場に立つにしても，まずは，その内容を正確に理解する必要があります。この授業では，法学を専門にしない人に対して，取調べと自白に関する基本的な知識を提供し，日本の刑事司法について自分の頭で考える機会を提供したいと考えています。
