This course aims to help students develop fundamental knowledge and analytical thinking skills necessary for understanding civil law, particularly contract law. In addition to instructor lectures, students will engage in practical learning activities such as case studies, mock trials, and mock mediation to develop the ability to resolve contractual issues they may encounter in professional practice through legal reasoning. Furthermore, the course content is closely aligned with topics covered in civil service examinations. Through the use of past civil service examination questions and similar materials, students will work to develop both critical thinking abilities and retain essential knowledge.
This course explores civil law, with a particular focus on contract law as it relates to practical challenges in welfare services. First, the course provides explanations of fundamental legal theories and key concepts related to contract law, and introduces relevant cases, news articles, and court decisions. Students then analyze the issues from the perspectives of the parties involved and deepen their understanding of the cases through discussions in mock trial and mock mediation formats, encouraging them to consider better solutions independently. Through peer review activities, students learn from others' perspectives and develop the ability to examine issues from multiple viewpoints. In the latter half of the course, students explore not only adversarial resolution through litigation but also collaborative dispute resolution through mediation. Additionally, the course incorporates past civil service examination questions related to each lecture topic to enhance understanding of the course material.

第3回、6回、9回、11回、13回では、実際に起きた事案について紹介します。予習として、各テーマのキーワードや事案の概要を事前に確認し、紹介された事案では何が起きたのか、何が問題となっているのかを把握しておきましょう。その際、自分なりの解決策を考えておくことで、法的な解決との違いや特徴をとらえ、問題点にも気づくことができます。
復習では、講義内容を暗記するよりも、理解することを優先して講義内容をふり返るようにしてください。特に、ディスカッションやピアレビューで得られた多様な視点を踏まえ、自分の考えを深めることが重要です。
予習と復習は、個々の学生によって所要時間が異なってくることと思いますが、予習にはおよそ30分、復習にはおよそ60分～80分程度要します。

民法を理解するうえでは、紛争当事者双方の立場から問題をとらえ、解決を考える思考力が不可欠です。しかしながら、法を初めて学ぶ人にとって、このような多角的視点に立って考えることはなかなか難しいことです。また、再び学びなおそうという人にとっても同様でしょう。よって、難しい概念や複雑な思考に直面しても根気強く学習に取り組み、積極的に議論する能力が求められます。

民法、特に契約法を理解するための基礎的知識と思考を身につけることを目標とします。教員による解説のほかに、事例検討や模擬裁判、模擬調停などの実践的な学習を通じて、実務において直面する可能性のある契約上の問題について、法的な思考に基づいて解決する力を養います。さらに、講義で扱う内容は、公務員試験の出題分野とも密接に関連しています。公務員試験の過去問等を活用し、思考能力だけでなく知識の定着を図ります。

本講義では、民法、特に契約法について、福祉サービスにおける実務的な課題に焦点を当てながら学習を進めます。まず、契約法に関わる民法の基本的な理論や重要概念について解説し、その内容に関連した事件やニュース、判例・裁判例を紹介します。そして、取り上げた事案について、当事者の立場から争点を整理し、模擬裁判や模擬調停の形式を使ってディスカッションすることで、事案の理解を深め、学生自身でよりよい解決を考えてもらいます。また、ピアレビューを通じて他者の意見から学び、多角的な視点から問題を考察する力を養います。講義の後半では、裁判による対立的な解決だけでなく、調停による協調的な紛争解決についても学びます。さらに、講義で取り扱ったテーマに関連する公務員試験の過去問を用いて、講義内容の理解を深めます。
