【Course Objectives】

The aim of this course is for students to acquire more specialized knowledge about Conflict of Laws and international codes of civil procedure.

【Course Contents】

Two companies from different countries conclude an international transaction, and a dispute occurs as a result. Under the existing international civil litigation scheme that uses a national court to resolve disputes, first, a dispute will occur regarding which country's court should resolve the corresponding dispute, and in many cases an efficient dispute resolution is uncertain. Now what if we were to resolve the dispute without using the court of either country or even resolve the dispute without using a national court in the first place? The dispute resolution process that was born from that concept is called "international commercial arbitration." It has long been used in the world of international commercial transactions mainly in the US and Europe and is increasing in importance.
This course aims to focus on international commercial arbitration, which is an extreme application of the Conflict of Laws and International Civil Procedure Law, deepening the students’ knowledge of Conflict of Laws and International Civil Procedure Law by analyzing the legal problems that occur there.
