社会デザイン研究科では、教室での対面授業を基本としながら、同時に遠隔地在住の学生の学びを保証するため、オンラインでも受講できる形で授業を行う。なお、履修者全員の了承が取れた場合には、「対面のみ」もしくは「オンラインのみ」で授業を行うこともある。 |
Students will understand the structure, in which the two directions of modern society; globalization and nation-state system create various crises affecting human rights and security.
Students will understand how each country and the international community have adopted human rights protection systems formulated as systems of rights and obligations.
Human rights are important legal concepts that govern modern society.
In the age of globalization, the international criminal justice and refugee protection systems created by world wars and armed conflicts have come to transcend national borders based on traditional border control. On the other hand, the development of exclusionary societies as seen in immigration exclusion is a stubborn attempt to keep the traditional nation-state concept. In addition, the great flow of the world economy has created global companies that are more powerful than traditional states, and this has a direct impact on people's lives.
How are governments and the international community trying to respond to such global movements using the human rights system, in this period which is said to be late modernity? We will consider the structure of the problem and what action to take in various cases.
We plan to change the priority of the topics as appropriate according to the study content of the students.

本科目は授業回の全てにおいて、理論等学術的な知見を踏まえつつ、担当教員の実務家としての経験、または研究成果を活かし、教員と学生との双方向の討論を重視した実践的な授業とする。学生には、課題の発表や討論など、授業での積極的な参加を期待する。
グローバル化とネーション＝ステートという近代社会を特徴づける二つの方向性が、人権や安全保障に影響するさまざまな危機を生み出している構造を理解する。
権利と義務の体系として作られた人権保障制度について、各国や国際社会がそれぞれどのような仕組みを講じているかを理解する。

人権は、近代社会を規律する重要な法的概念である。
グローバル化の時代を迎えて、世界規模での戦争や武力紛争が生み出した国際刑事司法や難民保護の制度は、従来の国境管理を基本とした国家の枠を超えてきている。一方で、移民排斥に見られるような排除型社会の進展は、従来の民族国家概念を頑なに守ろうとしている。また、世界経済の大きな流れは、従来の国家を超える存在としての世界企業を生み出し、人びとの生活に直接の影響を及ぼしている。
後期近代とも言われる現在、国や国際社会は、こうしたグローバルな動きに対して、人権という制度をどのように用いて対応しようとしているのか。さまざまなケースを通じて、問題の構造と、どのような対策を講じるかを考える。
受講者の研究内容に応じて、強弱を設ける予定。
