【Course Objectives】

To learn the establishment requirements which are common to multiple crimes or what is called the General Theory of Criminal Law.

【Course Contents】

The General Theory of Criminal Law is the field which covers the requirements to establish and reject multiple crimes such as the cause and effect relationship and the result, self‐defense, and the capacity for liability, for example. This field stands in contrast to Criminal Law: Specific Part which covers the specific requirements to establish individual crimes.
Due to the fact that this field by nature extracts and covers commonalities, the discussion tends to get abstract, which leads many people to dislike Criminal Law. To avoid this outcome, the lectures will use many specific cases to try and explain in a manner which is as easy to understand as possible. For example, we can use the following case when discussing cause and effect relationships.
“Mr. X thought about killing Mr. A and fired a pistol at his heart. As a result, the bullet missed and just grazed the arm of Mr. A. However, Mr. A in fact suffered from a rare disease that prevents blood clotting, so he died from blood loss on the spot. ”
Now, what crime will Mr. X be accused of? Has the crime of murder been established or is it only the crime of attempted murder?
