Bankruptcy law enables debtors to make a fresh start. In this course, students will study an overview of such a humanistic system. Bankruptcy law is a field of law which synthesizes procedural law and substantive law, and it is also an area which solidifies the knowledge you have learned in civil law in an enjoyable way.
This course will explain the opening of insolvency procedures, bankruptcy claims/estate claims/common basic claims, position of administrators, executory contracts, rehabilitation and reorganization plans, the progress and closure of insolvency proceedings, various problems of consumer insolvency, and international insolvency law. The topics will not be limited to bankruptcy proceedings, but also explain the details of the Civil Rehabilitation Act and Corporate Reorganization Act in an interdisciplinary manner.

倒産法は債務者の再出発を可能とする。本講義ではそのようなヒューマニスティックな制度である倒産手続の概要を修得する。倒産法は手続法と実体法を総合する法分野であって、諸君が民法で学んだ知識を立体化する楽しみもある領域なのである。

倒産手続の申し立てと開始、倒産債権・財団債権・共益債権、管財人の地位、双務契約の処理、倒産債務者財産の管理と換価、再生・再建計画、倒産手続の進行と終了、消費者倒産の諸問題、国際倒産処理について講述する予定である。いずれのテーマについても、破産手続に限定せず、民事再生法・会社更生法の内容も横断的に解説する。
