【Course Objectives】

 Administration is one government function which stands side-by-side with legislation and the administration of justice, but Administrative Law is the area which covers the legal framework (rules) concerning administration. With regard to government functions, the Constitution establishes fundamental matters based on the separation of powers and the guarantee of basic human rights, but Administrative Law specifically establishes the ideal form of administrative activities carried out by the nation and local public organizations based on the Constitution and "legally based administrative principles" (rule of law). Therefore, knowledge of Administrative Law is essential to understand the Constitution (especially constitutional litigation). Moreover, because on the other hand administration is also involved in individual areas such as taxation, labor and social insurance, environmental protection, economic regulation, and the protection of intellectual property, knowledge of Administrative Law is required for legal fields involved in these activities as well. In that sense, Administrative Law is positioned as a fundamental field of law together with the so-called six major legal codes (referred to as the seven major legal codes).
 With regard to the items indicated in the "class content", the fundamental objective of this course, including the introduction to Administrative Law, is to understand the fundamental way of thinking of Administrative Law to form a solid foundation for students aiming to become public servants, judicial officers, and corporate law personnel, etc. to achieve each of their goals.

【Course Contents】

 Within Administrative Law, this Administrative Law 1 course covers the basic principles of Administrative Law and the legal framework for administrative activities. Furthermore, the Administrative Law 2 course scheduled to be held during the spring semester of the 2020 academic year will continue on from Administrative Law 1 and cover the Administrative Remedy Act which establishes remedies for the violations of the people’s rights with regards to illegal administrative activities.
 Specifically, this course will explain (1) the basic framework of Administrative Law including the relationship between the Constitution and Administrative Law and the "principle of administration by law" which is the fundamental principle of Administrative Law. In addition, it will survey (2) administrative acts, administrative legislation, administrative guidance, administrative contracts, administrative planning, administrative compulsion, and other “action types of administrative activities.”
 The field of Administrative Law 1 has many individual matters (arguments, systems, etc.) which organically relate to other matters, so the lectures will also refer to the mutual relationships between such matters. Therefore, please note that when it comes to attending class, the content is such that you will ultimately understand the entire discussion if you listen from the beginning to the end.
