The aim is for students to deepen their understanding in the basics of laws pertaining to payments or settlements made in transactions involving goods or services.
Transactions related to goods or services generally involve a fee, entailing a payment or settlement by which a credit-debt relationship is terminated. We often use cash to make payments or settlements in our daily transactions. However, due to various risks, etc., it is rare for payments or settlements to be made in cash in the world of commercial transactions.
In this course, students will develop an understanding of the diverse payment methods and settlement methods used in our world from a functional perspective and learn about the legal mechanisms that regulate such methods.

本講義では、物やサービスの取引において行われる支払ないし決済に関わる法について、基本的な理解を深めることを目標とする。
The aim is for students to deepen their understanding in the basics of laws pertaining to payments or settlements made in transactions involving goods or services.
物やサービスに関する取引について、通常これは有償で行われ、支払という行為、ないし決済という債権債務関係を消滅させる行為が伴うことになる。われわれの日常の取引であれば、現金による支払・決済がなされることも少なくないが、商取引の世界では、さまざまなリスク等にかんがみて、むしろ現金によってそれが行われることはまれである。
本講義では、われわれの現実世界で用いられる多様な支払方法・決済方法を機能的に理解するとともに、これを規律する法的仕組みについて扱うこととしたい。
