The purpose of this course is for students to learn the basic structure of particular issues of how international laws are applied to private individuals and companies in this era of advancing globalization.
When a Japanese person and a foreigner marry, what law should be observed? When a Japanese company and a foreign company sign a contract, what law should be observed?
In our current international society where each country has a different legal system, international private law, also called Conflict of Laws, establishes which system of law (governing law) should regulate such international legal relationships. The importance of this area of law continues to expand as internationalization advances.
This course aims to make every effort to explain this often confusing area of law in an easy-to-understand manner by carefully describing, to the extent possible, the basic structure of particular issues of Japan's Conflict of Laws.

グローバル化が進展する現代における私人・私企業間の国際的な法の適用関係の各論の基本構造を修得させる。
The purpose of this course is for students to learn the basic structure of particular issues of how international laws are applied to private individuals and companies in this era of advancing globalization.
日本人と外国人が婚姻する場合，何法に従えばよいのでしょうか。日本企業と外国企業が契約を締結する場合，何法に従えばよいのでしょうか。
国際私法とは，各国ごとに法制度が異なるという現在の国際社会の状況の下，このような国際的な法律関係をいかなる法（準拠法）で規律するかを定める法であり，抵触法とも呼ばれるものです。国際化がますます進展する現代において，その重要性は拡大の一途をたどっています。
講義では，我が国の国際私法の各論の基本構造をできる限り丁寧に説明することで，ときに難解ともいわれるこの法をわかりやすく解説することを心掛けます。
