This course aims at acquiring the basic knowledge and points of view on the actual function of laws. In addition to that, it aims at cultivating the ability to envisage the ways to make laws and legal systems better.
Laws are not always realized in real-world conditions. Given this simple fact, the questions such as whether laws are realized or not and what factors are related to this actual function of laws emerge. This course will focus on these topics. Based on socio-legal studies on these topics, the roles and limitations of laws will be discussed.

実社会の中で法律がどのように作動しているのか，あるいはしていないのかという点について基本的な知識および視点を獲得する。そして，そのような観点から，どのような法律や法制度が望ましいかを考える能力を涵養することを目指す。
This course aims at acquiring the basic knowledge and points of view on the actual function of laws. In addition to that, it aims at cultivating the ability to envisage the ways to make laws and legal systems better.
法律の内容が実社会の中でどのように実現しているのか，あるいは実現していないのか，そのような実現／非実現は，どのような要因によって規定されているのか，という点を中心に扱う。そのような司法過程の現実を踏まえながら，法律が社会の中で果たしている役割や，その限界について論じていく。

講義を通してトピックと関連する基本的な文献を紹介する。関心のある内容について，それらの文献を参考にしながら学習を進めることを推奨する。また，教科書として指定するものではないが，参考文献中の村山眞維・濱野亮（2019）『法社会学（第3版）』有斐閣は，本講義の内容を学習するうえで参考となる基本書である。授業の進行にあわせて，この教科書を読み進めることも推奨する。
