This course aims to provide students an insight into some of the central questions concerning the intersection between law, peace and society. Law and peace are vague conceptions that arguably reflect society's issues, challenges, and aspirations.
Students will have the opportunity to think critically about social issues and legal approaches to argue whether the law can indeed be an effective tool for peace.
The objectives of this course are to help students:
1) have a basic understanding of law and peace from an interdisciplinary view
2) develop skills to critically analyze key social and legal issues
3) think about peace, law, and justice from Japanese and global perspectives
Students will first understand peace-related concepts such as positive, negative, and cultural peace and analyze how these concepts relate to law. Students will also engage with theories on nonviolence and question how law and pacifism work together. After these initial steps, the course is basically divided in two sections. The first section focuses on whether and how states can go to war, how the law applies once war breaks out, and how criminal liability happens. The second section focuses on some topical issues concerning the intersection between law and peace (drugs, minorities, the criminal system, and human trafficking).
The counter element of peace is violence. Accordingly, this course deals with large-scale violence and violent behavior as breaches of peace and law.
Please be aware that sensitive topics such as human trafficking will be discussed.
